We check the register for identical and deceptively similar marks in the relevant classes before you commit.
A trademark protects the name, logo or tagline that identifies your business. Registration is done by class — goods and services are divided into 45 classes and you register in the ones you actually trade in. Makhija & Company runs the availability search, files the application and handles examination objections and opposition.
| What can be registered | Brand name, logo, tagline, and certain other distinctive marks |
|---|---|
| Classification | 45 classes under the Nice classification; you file in the classes you trade in |
| Process | Search, filing, examination, publication in the Trade Marks Journal, then registration |
| Use of ™ and ® | ™ may be used once applied; ® only after registration is granted |
| Validity | Ten years from the date of application, renewable |
| Common problem | Objection at examination, or opposition after publication — both answerable |
A brand you have built for years can be claimed by someone who filed first. That is the whole case for registering: the cost of an application is trivial next to the cost of rebranding, or of a dispute with someone who now holds the registration for your own name.
The two decisions that matter are the search and the classes. A search done properly tells you whether the mark is realistically available before you spend money. The class selection decides what your registration actually protects — filing in the wrong class leaves the business you care about unprotected.
If one of these sounds like you, this is the right page.
This is the general set. After the first call you get one checklist built for your exact case, rather than a generic list you have to interpret.
That is what the free consultation is for. Tell us the situation and we will tell you the shortest route through it — including when the answer is that you do not need this service at all.

In a market area, two businesses trading under similar names is normal until one of them registers. We have seen owners around Ghantakarna Market discover that the name over their shop for fifteen years now belongs to somebody else on paper. The search costs very little and tells you where you stand before you spend on signage or packaging.

The right classes are chosen for what you actually sell, and the application is filed.
If an objection is raised, we draft and file the reply, and appear at hearing where required.
The mark is published in the Journal; if unopposed, it proceeds to registration.
QHow long does trademark registration take?
Filing is quick; registration is not. The application passes through examination, possible objection, publication in the Trade Marks Journal and an opposition window before registration is granted. The whole cycle typically runs well over a year even when nothing goes wrong, which is why applying early matters.
QCan I use the ™ symbol before registration?
Yes. ™ may be used once you have applied. The ® symbol may only be used after the mark is actually registered — using it before then is itself a problem.
QWhat if my trademark application is objected to?
A trademark objection at examination is common and is not a refusal. It requires a written reply addressing the examiner's ground, sometimes with evidence of use, and occasionally a hearing. We draft and file that reply.
QHow many classes should I register in?
Only the ones you actually trade in, plus any you have a concrete plan to enter. Each class adds cost, and a registration in classes you do not use is vulnerable to challenge for non-use.
QDoes trademark registration cover the whole of India?
Yes, a registration under the Indian trade marks system applies nationally. Protection in other countries requires separate filings there.
